1. Presentation of the service
Artivelle, available at https://artivelle.art, allows users to create personalised artworks using artificial intelligence, then order them as printed pictures, framed or unframed.
These general terms of sale (the "terms") govern purchases made on the Artivelle website. They will apply from the opening of the commercial service.
Before placing any order, the Customer must read and accept these terms.
2. Creating and personalising artworks
The Customer can create an artwork from a description, artistic preferences or a photograph of their interior.
They can then personalise their picture by choosing, in particular, its size, its frame and the available options.
Previews and room views are provided for guidance only. Slight differences in colour, texture or proportions may appear between the on-screen display and the printed product.
3. Uniqueness of creations
Artworks are generated from users' descriptions, inspirations and preferences.
Artivelle does not offer the creations made by its users for sale to other customers.
However, artificial intelligence technologies may produce similar or even identical images, in particular when several users submit comparable descriptions, settings or inspirations.
Artivelle therefore does not guarantee the absolute uniqueness of creations or the exclusivity of their style, subject or composition.
4. Use of creations and intellectual property
The Customer may use the images generated from their account for personal purposes.
The Customer undertakes not to submit unlawful content or content that infringes the rights of third parties, in particular copyright, trademarks or image rights.
Artivelle may refuse a creation or an order that does not comply with these rules. Any paid order refused on these grounds will be refunded.
Any rights in the generated images are subject to the applicable legislation, in particular on intellectual property.
5. User accounts and tokens
Some Artivelle features require an account.
Artificial intelligence features may work with a token system, used in particular to generate, edit or adapt images.
Free tokens and any paid packs are presented on the website with their terms of use and prices.
The Customer undertakes not to misuse the service, in particular by creating several accounts to improperly benefit from advantages reserved for new users.
Artivelle may suspend an account in the event of fraud or abusive use, after informing the user.
6. Orders and payment
The Customer selects their artwork, size and framing options before confirming their order.
The total price, including applicable delivery charges, is shown before payment.
Payments are made through Stripe, using the payment methods offered at checkout.
The order is confirmed once payment has been validated. A summary is sent to the Customer by e-mail.
7. Prices
Prices are shown in euros, under the VAT scheme applicable at the time of sale.
Delivery charges are shown separately before the order is confirmed.
The applicable price is the one displayed when the order is confirmed.
8. Production and delivery
Pictures are made to order, according to the specifications selected by the Customer.
The available destinations, delivery charges and applicable delivery times are shown before the order is confirmed.
In the event of late delivery, the Customer has the rights provided for by the French Consumer Code.
The risk of loss or damage passes to the Customer when they take physical possession of their order, in accordance with the applicable legal provisions.
9. Right of withdrawal
In accordance with Article L221-28, 3° of the French Consumer Code, the right of withdrawal does not apply to goods made to the consumer's specifications or clearly personalised.
This exception covers pictures actually personalised according to the Customer's choices.
The Customer nevertheless retains their rights under the legal guarantees, in particular in the event of a defective or non-conforming product.
Any purchases of digital tokens are subject to the withdrawal rules applicable to digital content and services.
10. Damaged products and guarantees
